Who is Eligible for a Chapter 7 Discharge?
Generally, everyone experiencing a financial hardship is eligible for Chapter 7 relief unless:
(a) you have already filed a Chapter 7 bankruptcy and received a discharge in the last eight years,
(b) you have already filed a Chapter 13 bankruptcy and received a discharge in the last six years (unless you paid 70% of your unsecured claims in that case), or
(c) you have primarily consumer debt and you make too much money to qualify for Chapter 7 relief and/or an abuse of the bankruptcy system would result if you were released from your debt (i.e., it would not be “fair” for you to be granted a discharge).
