Credit Counseling

If you plan to file for bankruptcy protection, you must obtain a credit counseling certificate from a government-approved organization within 180 days before you file.

Pre-Bankruptcy Counseling

You must obtain counseling from an agency approved by the U.S. Trustee’s Office.  View a list of approved agencies.

Typically, a counseling session lasts 60-90 minutes. It can be completed in person, on the phone, or online. The fee is generally around $10-20, but if you can’t afford to pay, ask the organization about a fee waiver.

When you complete the counseling, you will receive a certificate.  Keep this document safe, and provide a copy to our office.  Often, they will provide a copy to our office if you ask them to do so. Either way, we must receive a copy of the certificate and file it with your bankruptcy petition. Pre-filing certificates are good for six months. YOUR CASE CANNOT BE FILED WITHOUT THE CERTIFICATE.

Post-Filing Debtor Education

After you file, you must complete a second debtor education course before you can receive your discharge.    This course will cover topics such as developing a budget, managing money, and using credit wisely. This course is actually quite useful. This education can take place in person, on the phone, or online, may take about two hours, and the fee is between $20 and $40. If you can’t afford to pay, ask the provider about a fee waiver.

When you complete the course, you will receive another certificate. Keep this document safe, and provide a copy to our office. Often, they will provide a copy to our office if you ask them to do so. Either way, we must receive a copy of the certificate and file it with the court in order for you to receive a discharge.  THE COURT WILL NOT ENTER YOUR DISCHARGE ORDER WITHOUT IT.

Where To Send The Certificates

The provider can email your certificate to Certifcate@RRLawGRoup.com.   Also, please follow up with our office to confirm we have received the certificates.  Every once in a while the provider has not sent it.  SO, it is good idea for you to just double-check.  Thank you!
